De Anza College does not tolerate any form of sexual assault, including rape, or sexual harassment on college property or at any college-sponsored event. These situations may or may not be deemed criminal offenses and therefore may be handled both internally through college administrative action and externally by the appropriate law enforcement agency if warranted.

Within the college, allegations of sexual assault or rape will be fully investigated by the college Title IX coordinator. Disciplinary sanctions may include suspension or expulsion for students or suspension or termination for employees.

Decisions regarding discipline of employees will be made in accordance with applicable legal and contractual provisions and procedures.

If an individual contacts the Mental Health and Wellness Center or Student Health Services about being raped or sexually assaulted, the information will be treated as confidential and will not be shared with others, except in cases involving minors.

If the individual decides to report the incident to a law enforcement agency, the Title IX coordinator or any college employee outside the Mental Health and Wellness Center or Student Health Services, the information may be shared with other employees in order to provide support and assistance, but the college will make every effort to handle the information in the most private manner possible.
